The Proposal

N. P. Power Pty Ltd proposed to construct and operate a Level 2 wind farm on the eastern shore of Lake Echo.

The proponent lodged a Development Application with a supporting Development Proposal and Environmental Management Plan (DPEMP) to Central Highlands Council (Council).

The proposal was referred to the Board of the Environment Protection Authority (the Board) for assessment under the Environmental Management and Pollution Control Act 1994 (EMPCA).

The DPEMP guidelines were prepared by the Board. Draft DPEMP Guidelines were advertised for public comment and the comments received were taken into account in the final guidelines. The project specific guidelines can be veiwed at the bottom of this page.


Environmental Assessment Report and EPA decision

The environmental assessment report has now been completed and can be viewed below. This report contains an environmental assessment and recommendations to the Board in relation to the proposal.

The permit conditions required by the Board to be included in the planning which was first granted by Central Highlands Council can also be viewed below. It should be noted that the conditions were subsequently amended as detailed in the section following.

Planning Appeal and Permit

Central Highlands Council issued a planning permit to NP Power Pty Ltd containing the permit conditions required to be contained therein by the Board.

The permit was appealed by NP Power. An agreement was reached between the parties to the appeal. Subsequently the Resource Management and Planning Appeal Tribunal (RMPAT) directed Council to issue an amended permit in accordance with s17 of the Resource Management and Planning Appeal Tribunal Act 1993. The permit includes amendments of conditions required to be included by the Board. The amended permit can be viewed below.

Approval by the Australian Government

The proponent has referred the proposal to the Australian Government for consideration under the Environment Protection and Biodiversity Conservation Act 1999 (EPBC Act). The Australian Government has determined that the proposal is a controlled action on the grounds that it is likely to have a significant impact on the following matters protected by the EPBC Act:

  • Listed threatened species and communities, section 18 and 18A; and
  • Listed migratory species, sections 20 and 20A.

As such, it requires assessment and approval by the Minister for the Environment, Heritage and the Arts before it can proceed.

The proposal will be assessed by Tasmania in the manner specified in the Bilateral agreement between the Commonwealth of Australia and the State of Tasmania under Section 45 of the EPBC Act.


Supporting Documentation

A copy of the permit application, and of all plans and other documentation submitted with the permit application (including the DPEMP) were made available for public inspection. Following the public comment period the proponent was required by the Board to prepare a DPEMP Supplement to address issues raised during the consultation period.
