Roles and Responsibilities of Controlled Waste Handlers

In addition to the roles and responsibilities defined in the Environmental Management and Pollution Control Act 1994 (EMPCA) and the Environmental Management and Pollution Control (Waste Management) Regulations 2010 (the Waste Management Regulations), controlled waste handlers now have registration obligations under the Environmental Management and Pollution Control (Controlled Waste Tracking) Regulations 2010 (the Controlled Waste Tracking Regulations).

Controlled Waste Producers

If you consign a controlled waste for transport, you will need to:

  1. be registered as a controlled waste producer; or
  2. appoint a controlled waste agent to manage your controlled waste tracking obligations.


If you become registered as a controlled waste producer, you may still appoint a controlled waste agent for particular waste movements.

If you are registered as a controlled waste producer, you will be authorised to handle specific controlled waste categories (you will need to state the relevant waste categories in your registration application).

Controlled waste producers may already be regulated by the EPA under the provisions of the EMPCA. You may be operating under the environmental conditions of a land use planning permit, an environment protection notice, a regulation 12 approval issued under the Waste Management Regulations or another instrument. The existing regulatory approval does not provide approval to consign waste under the Controlled Waste Tracking System and you will need to either register under the Controlled Waste Tracking Regulations or appoint an agent when you wish to consign waste.

Controlled Waste Transporters

If you transport controlled waste by road, you will need to be registered as a controlled waste transporter. You will be authorised to handle specific controlled waste categories (you will need to state the relevant waste categories in your registration application).

Previously held Waste Transport Business Environment Protection Notices under EMPCA have now ceased to have effect in respect of controlled waste movements solely within Tasmania, and you will need to register under the Controlled Waste Tracking Regulations.

Controlled Waste Agents

If you are a controlled waste transporter who wants to manage controlled waste tracking obligations on behalf of a producer, you will need to be registered as a controlled waste agent. You will be registered as both a controlled waste transporter and controlled waste agent to handle specific controlled waste categories.

Previously held Waste Transport Business Environment Protection Notices under EMPCA have now ceased to have effect in respect of controlled waste movements solely within Tasmania, and you will need to register under the Controlled Waste Tracking Regulations.

Controlled Waste Facilities

If you receive controlled waste for energy recovery, recycling, incineration, storage, reuse, reprocessing, treatment or disposal, you will need to be registered as a controlled waste facility operator. If you operate a controlled waste transfer depot, at which controlled waste is received for transfer, you will also need to be registered as a controlled waste facility. As either a receiving facility or a transfer depot, you will be authorised to handle specific controlled waste categories (you will need to state the relevant waste categories in your registration application).

Controlled waste facility operators may already be regulated by the EPA under the provisions of EMPCA. You may be operating under the environmental conditions of a land use planning permit, an environment protection notice, a regulation 12 approval issued under the Waste Management Regulations or another instrument. The existing regulatory approval does not provide approval to receive waste under the Controlled Waste Tracking System and you will need to register under the Controlled Waste Tracking Regulations.
