Marine-related incidents (MARPOL Implementation) Regulations 2020

​​Overview

The Marine-related Incidents (MARPOL Implementation) Regulations 2020 (the Regulations) were made under section 72 of the Marine-related Incidents (MARPOL Implementation) Act 2020 (the Act) and came into effect on 1 January 2021. 

​The Regulations prescribe various matters necessary to support the operation of the Act. This includes the identification of officers who may exercise certain powers under the Act including for the purpose of receiving notification of pollution incidents from ships, record book requirements for ships, and requirements for hazardous chemical cargo packaging and handling.

The Regulations also prescribe the means for calculating interest on outstanding costs to be paid and the infringement notice offences and penalties in respect of any matters committed under the Act.

Provisions

Provisions of the MARPOL Regulations include:

  • a list of infringement offences for the purposes of section 67 of the MARPOL Act
