Successful prosecution for discharge to North West Bay

Tasmanian salmon producer, Aquatas Pty Ltd was today fined ,000 in the Hobart Magistrates Court for discharging a pollutant into North West Bay in February 2005.

The company pleaded guilty to two offences under the Environmental Management and Pollution Control Act 1994.

The offences occurred between 8 and 9 February 2005 when sludge and wastewater from a treatment lagoon at the Company’s Margate factory were pumped into a creek leading into North West Bay.

Magistrate Helen Wood said that there was significant culpability on the part of the company and she viewed the offence as moderate to serious, as there was significant potential to harm ecosystems within the bay, as well as the recreational amenity of the area.

The Director of Environmental Management, Mr Floyd Browne, said that the incident demonstrated that appropriate procedures must be followed in undertaking work that has the potential to adversely affect the environment.
